The Contractor warrants the installation and workmanship for a period of Three (3) years for coatings and Five (5) years for ¼ inch floors from the date of commencement of a. This warranty is limited to lifting, peeling, and debonding of the materials from substrate, and excludes normal wear and tear. Work will be performed in a professional and workmanlike manner, in compliance with general industry standards.
The Contractor is not responsible for damage caused by capillary movement, substrate cracking, hydrostatic or osmotic pressure, fire, explosion, flood, war, radiation, act of God, vandalism, negligence, maintenance neglect or physical abuse. Customer’s sole remedy for breach of this warranty will be repair of any defects in installation and workmanship. Customer agrees that the repair of any defects in installation and workmanship is its sole remedy, and Contractor shall not be responsible for any other direct, indirect, or consequential damages relating to or resulting from any defect in materials, installation, or workmanship.
Customer is relying on the warranty from the manufacturer for any warranty on materials. Contractor specifically excludes any warranty of the materials used.
PPI will not perform any tests on the slab for contaminants, nor will we pull any cores for testing. It’s the sole responsibility of the Customer to perform these tests. PPI and industry experts recommend these tests are performed on every slab before installation. PPI is installing the system under the pretense that the concrete slab was poured to general industry standards and void of any irregularities.
The Contractor shall not be liable for any indirect, incidental, consequential or special damage arising from or outside of performance of this Agreement, the products or their installation, regardless of whether the Contractor was informed of the possibility of such damages. Contractor’s liability shall in no event exceed the cost of material and labor for repair or replacement of damaged coatings so covered by Warranty. Customer understands that it is the Customer’s responsibility to have a representative present when the non-slip additive is added to approve the amount of non-slip additive added to the flooring system. The Customer agrees to indemnify and hold harmless the Contractor for any liability due to Customer or any third party due to any slip and fall accident or other accident or injury.
OTHER THAN THE WARRANTY SPECIFICALLY PROVIDED ABOVE, CONTRACTOR DOES NOT EXPRESSLY OR IMPLIED WARRANT ANY PRODUCTS SOLD, OR SERVICES PROVIDED, TO CUSTOMER TO BE MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE. ANY DEFECTS CAUSED BY IMPROPER USE VOIDS ANY AND ALL WARRANTIES EXPRESSED OR IMPLIED BY CONTRACTOR OR CONTRACTOR’S VENDORS, EXCEPT THE WARRANTY OF TITLE. ANY PRIOR EXPRESSED OR IMPLIED WARRANTIES OR SERVICE/INSTALLATION INSTRUCTIONS ARE SUPERCEDED BY THIS PROVISION.
The customer is responsible for a concrete slab poured to industry and job specific standards and free of any contamination, including bond breakers or other chemicals.
PPI agrees to Prepare floors to a CSP 2-4, mix and install products within general industry standards.
